Notice of Changes
DCC reserves the right at any time and in its sole discretion to change the terms and conditions contained in this Agreement, other Service-specific terms and conditions, or any policies or guidelines governing the Services. Any changes to the Site, including terms and conditions, or policies and guidelines referenced in the Agreement, will be effective upon posting of such revisions on the Site. We will post a notice of any changes to this Agreement on the Site for at least thirty (30) days after the changes are effective. You are responsible for regularly reviewing the Site for any changes and notice of any changes. Your continued use of the Site and the Services following our posting of any changes to the Agreement on the site will constitute your acceptance of such changes or modifications. If you do not agree with any changes to this Agreement or the Site, then you must discontinue your use the Services or the Site.
Terms and Termination
This Agreement will remain in effect until terminated in accordance with this Section. You may terminate this Agreement at any time by discontinuing the use of the Site, and we may terminate this Agreement at any time by sending you an e-mail notice of termination at the e-mail address associated with your account. Our notice of such termination will be effective at the time we send you the notice. Upon any termination of this Agreement, all rights granted to you under this Agreement will cease and your account for the Site will be revoked and you must promptly discontinue all use of any Content downloaded or otherwise obtained from the Site.
Content
The Site and the entire contents of the Site, including, but not limited to, text, files, images, graphics, illustrations, audio, video, and photographs on or offered through the Site (collectively, "Content") are protected intellectual property of DCC. DCC’s intellectual property rights in the Content include, as applicable and without limitation, copyrights, trademarks, patents, and other proprietary and intellectual property rights ("Intellectual Property Rights").
Use of Content
Your access to or use of the Content is subject to the terms and conditions of this Agreement. You may use the Content only in the form provided on or through the Site solely for your own informational purposes. You may not resell the Content, and you may not use the Content for any purpose beyond normal Church use. All use of the Content must be accompanied by an acknowledgment that the Content is owned by DCC. You must not share any of the Content downloaded from this site with other churches or ministries. You must otherwise abide by all Intellectual Property Rights, notices, information, or restrictions contained on or in any Content. Unless otherwise noted on the Site, as between You and DCC, its partners, affiliates, and licensors ("Affiliates"), all Content is owned by DCC and its Affiliates. Except as stated in this Agreement, You are granted no licenses or rights, whether by implication, estoppel, or otherwise, in or to the Site or Content, or any Intellectual Property Rights therein or related thereto, and You may not modify, reproduce, perform, display, create derivative works from, republish, post, transmit, participate in the transfer or sale of, distribute, or in any way exploit any portion of the Site or Content without the prior written permission of DCC. If you would like to use the Content in a manner that is not expressly set forth in this Agreement, please contact us using the "Contact Us" page. A link to the Contact Us page is on the bottom of each page of the Site.
Indemnification
You hereby indemnify, defend, and hold harmless DCC and its Affiliates, subsidiaries, employees, agents, contractors, assigns, licensees, and successors in interest ("Indemnified Parties") from any and all claims, losses, liabilities, damages, fees, expenses, and costs (including attorneys' fees, court costs, damage awards, and settlement amounts) that result from any claim or allegation against any Indemnified Party arising from Your accessing the Site or Your breach of any term of this Agreement. DCC will provide You with notice of any such claim or allegation, and DCC will have the right to participate in the defense of any such claim at its expense.
PRIVACY POLICY.
DCC’s privacy policy, which is available here (the "Privacy Policy"), is incorporated in this Agreement by reference. By accepting this Agreement, You expressly consent to the use and disclosure of your personally identifiable and other information as described in the Privacy Policy, which may be amended by DCC from time to time.
Access to Rio Essentials
By accepting this Agreement and entering your Access Code you are granted access to the Rio Essentials resources during the calendar quarter you have purchased. The Rio Essentials resources include a training kit, lesson resources, videos, activity pages, and other Content as may be added from time to time by DCC. Notwithstanding the limitations set forth in the “Use of Content” paragraph above, DCC hereby grants to you, during the calendar quarter you have purchased, a limited, non-exclusive, non-transferable license to reproduce the training kit and the activity pages. Any reproduction of the activity pages shall be limited to four (4) copies of each activity page. Any reproduced Rio Essentials resources shall be used solely at your church or your other ministry site. If You or DCC terminate this agreement your access to Rio Essentials will be terminated immediately.
Forum Guidelines
The guidelines for the Rio Forums are simple: before you post, ask yourself if the post is Honoring Christ and respectful to others. We want you to build real relationships with the other users here so feel free to talk about yourself and your challenges/triumphs in life and ministry in the appropriate forums. As part of a diverse faith community there will be times where our beliefs don’t always line up perfectly. Please stay respectful of each other’s beliefs and don’t post in a hostile or demeaning way if you choose to discuss your differences. The moderators in their sole discretion have the right to move, lock, or delete posts or threads that are deemed to be inappropriate for the forums. Remember that when you created an account for Rio and any time you post you are agreeing to abide by this Agreement. Thanks for being a part of the Rio community! Limitation/Disclaimer
THE SITE IS PROVIDED BY DCC “AS IS” WITH NO WARRANTIES. NEITHER DCC NOR ITS AFFILIATES GUARANTEE OR ENDORSE THE ACCURACY, RELIABILITY OR FUNCTIONALITY OF ANY INFORMATION DISPLAYED, DISTRIBUTED OR ACCESSED THROUGH THE SITE. YOU AGREE THAT YOUR USE OF THE SITE IS AT YOUR OWN RISK AND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY RESULTING LIABILITY OR DAMAGE YOU INCUR. EXCEPT WHERE PROHIBITED, DCC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING, WITHOUT LIMITATION, ALL WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL DCC BE LIABLE FOR ANY DIRECT, CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY, PUNITIVE OR ANY OTHER DAMAGES, WHETHER IN CONTRACT, TORT OR ANY OTHER LEGAL THEORY IN CONNECTION WITH YOUR ACCESS TO AND USE OF THE SITE.
Governing Law
This Agreement will be governed by the laws of the State of Colorado, without giving effect to any conflict of laws principles. You hereby irrevocably and unconditionally consent to the jurisdiction and venue in the state and federal courts sitting in Denver, Colorado. In the event that DCC is required to enforce the terms of the Agreement against you, DCC will be entitled to recover its reasonable attorneys’ fees and expenses from you.
